General Terms and Conditions

In these terms and conditions (“we”, “us” and “our”) relate to Positive Media Company CIC. Access to our services is done so in accordance with these terms and conditions, and you accept and agree to be bound by the terms of this agreement and will be subject to any posted guidelines or rules as applicable. The website and its components are offered for informational purposes only. As such, we will not be held responsible for the accuracy, usefulness or availability of any information transmitted or made available via the website. We reserve the right to change these terms and conditions from time to time and your continued use of our services will signify your acceptance to these terms. You are advised to re-read this statement on a regular basis and these terms can also be made available to you upon arrival of our studio.

Use of the Studio

You may, at your own discretion and expense, obtain personal insurance for loss, injury or damage that you may sustain from use of the studio. Your use of the studio is done so at your own discretion and you accept any injury or illness sustained is done so at your own responsibility.

As a client of Positive Media Company CIC, you agree to comply with the rules outlined below. This includes the use of our facilities, our opening hours and your own personal conduct. We reserve the right to make changes to these rules periodically.

Recording Sessions

File Transfer

Recordings made at our studio will be sent to you via means of online transfer. Once the files have been received and/or downloaded, we will accept no responsibility for the loss or corruption of these files.

Storage of Files

We store raw recordings and completed projects for one month after the completion of the project. As such, we cannot guarantee access to any of these files beyond that period. It is your responsibility to ensure the safe storage and backup of these files after this time frame.

Copyright Material

You are responsible for any copyright or licensing issues that may arise. Any copyright, license fee, or royalty payments due to any third party for use of their work, including the use of samples, are your sole responsibility. You agree to not hold Positive Media Company CIC liable for any violations of copyright.

Technical Difficulties

Technical difficulties, including equipment failure and human error, may arise from time to time. Though these instances are extremely rare, on occasion, we may cancel and re-book the session at a time that is mutually agreed by both parties if these difficulties cannot be fixed promptly.

Should any booking be cancelled or rescheduled due to your technical difficulties or as a result of human error, you accept responsibility for the payment of any lost studio time.

Studio Bookings

Opening Hours

Our studio is open between the hours of 10am and 6pm, Monday to Friday (excluding Bank Holidays). However, we are able to accommodate bookings outside of this time frame; contact us for more information. There is a surcharge for bookings outside our standard opening hours.

We are closed on Bank Holidays and for a short period over Christmas and New Year.

Payments

We require a deposit to secure your booking with us, this is usually 50% of the total amount. We will provide an invoice for both the deposit and final payment. Payments can be made online by card (including Apple Pay and Google Pay), or by bank transfer.

Refunds and Cancellations

If you wish to cancel or reschedule a booking, you must notify us by phone or email 48 hours prior to the booking. If reasonable notice is not given, charges will apply as follows:

  • 48+ Hours’ Notice: No Charge
  • 24-48 Hours’ Notice: Half of the Charge
  • 24 Hours’ or Less Notice: Full Charge

Studio Time

Our facilities can be booked in hourly slots. We ask all clients to be aware that if there is another booking directly following yours, you will need to finish promptly to allow for a changeover. If your booking runs over and impacts another client, a surcharge will be applied.

Studio Rules

All clients agree to abide by our studio rules. Any failure to comply may result in your booking being cancelled without access to a refund.

The studio rules include, but are not limited to, the following actions:

Abusive behaviour, in any form, towards staff or other users of the facilities. This includes rude, disrespectful, or any behaviour deemed offensive, including derogatory remarks and disruptive acts amounting to verbal and emotional abuse; sexually inappropriate comments and behaviour; racist and discriminatory abuse; threats of physical violence, aggressive and violent behaviour.

Smoking (including the use of e-cigarettes) or the use of illicit drugs is prohibited on the premises. The consumption of alcohol during standard bookings is not permitted. If you are unsure about any of these rules, please contact us or speak with a member of staff upon arrival.
